If Yanukovych is reinvested with Kuchma’s powers, president and parliament must be reelected
If the Constitutional Court invalidates the 2004 constitutional reform which clipped Kuchma’s powers and made Ukraine a parliamentary-presidential republic, all elected bodies elected under the 2004 Constitution should be reelected as their authority had been changed by the 2004 reform, Yury Yakymenko of the Razumkov think tank told ZIK July 21.The 2004 reform can be invalidated as running counter to the Constitution. On the other hand, president and parliament have been elected under the altered Constitution.
“That is why I believe the CC will endorse a very cautious ruling,” the expert saide.
