Tymoshenko accuses Yanukovych of bending Constitution
Speaking late March 5 in the Shuster Live talk show, Yulia Tymoshenko charged Pres Viktor Yanukovych with bending the Constitution, ZIK reports.As Yanukovych team keeps pushing ahead with the creation of a ruling majority, the procedure used runs counter to the Constitution, Tymoshenko said. Under the Constitution, a majority can be formed only by parliamentary factions, not individual lawmakers.
She accused Regions of intimidating or buying up other factions’ lawmakers into joining their coalition, with bribes amounting to 3-5 million dollars offered.
The violations have been blessed by Yanukovych and are implemented by Speaker Lytvyn who had unlawfully proclaimed on March 4 the absence of the coalition while none of its member factions had formally quitted the coalition.
“Not a single president had a start like this. It’s a very bad start for his presidency. If Yanukovych spurns the Constitution so openly, how can he be the guarantor of the main law?” Tymoshenko asked.

Ah! The agreements she had with Yanutin, before he pulled out. She deserves respect from no one.
[Others have] characterized the "Whore Lytvyn", so should she be put in the same group. She's proven it over and over again. If she wouldn't have, she would've been chosen president, hands down. Tell us who hadn't she deceived? Can you answer that question? I doubt it.

In 2007 Yushchenko claimed that the parliament was acting unconstitutionally in that it was seeking to obtain support for Constitutional reform that would see Ukraine re3move authority and power from the President and create a full Parliamentary democracy. Yushchenko argued, wrongly at the time, that the imperative mandate provisions of Ukraine's Constitution prohibited individual members of Parliament from voting on Constitutional matters. and as such he claimed he had the authority to dismiss the parliament.
The Truth is that the imperative mandate provisions prevents individual members of parliament from determining the formation of the governing coalition. Only factions can determine the formation of a governing coalition. Article 83. Members of Parliament MUSt remain a member of the faction that elected them, they can not .sit as independents. If they resign or are removed from membership of the faction they automatically lose thicker mandate.
Whilst the imperative mandate effects the formation of the government and a members mandate it does not prevent then from voting on issues as an individual. Thugs members of parliament can note as individuals on issues of no-confidence. If they do act against the interest of the faction which elected them then they also run the risk of losing their mandate or support in future elections. Such persons are commonly referred to as rats.and are soon drumed out of the party/faction to which they belong.
