Experts on Tymoshenko chances to win lawsuit
Experts believe Tymoshenko has submitted to court the smoking gun that gives her a good chance to win. However, they doubt that with judges the rule of law will outweigh political expediency, UNIAN reports Feb. 17.Speaking to The Political Thought Internet journal, Taras Berezovets said,” BYT’s appeal contains convincing information on vote-rigging. Video footage and printed materials pointing to electoral fraud are conclusive. However, the Higher Administrative Court will be guided by political expediency, not by the law.”
Berezovets does not expect the court will cancel the election results, render them falsified and rule to hold a revote. In this case, Tymoshenko will have to appeal to the Supreme Court of Ukraine, he believes.
The most urgent task now is to suspend Rada’s decision to appoint Yanukovych inauguration for Feb. 25. In fact, the expert continues, HAC has suspended CEC decision to recognize Yanukovych as winner pending consideration by HAC of Tymoshenko’s complaint.
However, HAC ruling will fall flat on Regions ears, as Yanukovych is not guided by any legal dimension, he will likely flout HAC’s ruling, Berezovets said.
Olexy Holobutsky, for his part believes Tymoshenko’s appeal is sufficiently convincing. “As citizen and expert, I could see the vote-rigging, and small wonder the Higher Administrative Court has suspended CEC decision to declare Yanukovych winner. I do not rule out that the court may order to postpone Yanukovych inauguration, as the smoking gun submitted by Tymoshenko casts doubt over the fairness of the election.”
Political expert Volodymyr Polyakov points out that the credibility of evidence submitted to court by Tymoshenko has surpassed all expectations. It impressed the judges so much that HAC suspended CEC decision declaring Yanukovych winner.
As no repeat runoff election is impossible from the legal point of view, chances for the recount or invalidation of election results at some constituencies are good.
However, Tymoshenko can hardly win her case as HAC is dominated by the Regions, Polyakov stresses.
Ihor Zhdanov, Open Policy analytical center president, says the Tymoshenko lawsuit was prepared by experienced lawyers and includes a lot of evidence.
The expert cited the 300,000-strong difference between the number of voters in the state roster and the number of voters added to the roster on the day of voting. The 300,000 new voters voted several times, Tymoshenko lawyers say.
It is vital that the court’s sessions be open to public and journalists, the expert said. Then, Ukrainians will be able to see whether HAC is impartial and can pass legal, not political, rulings.
